Bill Analysis

SB 941 would direct the Department of Transportation to plan, design, and establish a program for designating highways as State Scenic Byways. Creating such a program would allow federal grant funds to be used for creating Scenic Byways. The bill would allow the use of state highway funds if the federal grant is not sufficient to cover the costs.

Vote Recommendation Notes

Quoting from the Fiscal Note by the Legislative Budget Board: "For the purposes of this analysis, it is assumed a project receiving a federal grant would include a federal share of 80 percent and non­federal share of 20 percent of the project cost, and a third­ party would contribute funds toward the non­federal share or other costs not covered under the federal grant." 

Rather than allow the nonfederal share to be covered by state highway funds, we recommend SB 941 be amended to prohibit state highway funds from being used to cover the gap which should be covered by private contributions or political subdivisions of the state seeking the Scenic Byway designation.
