Bill Analysis

SB 838 would require the Texas School Safety Center to develop best practices for school districts and open-enrollment charter schools that authorize a school guardian program to provide safety and security, and would require that a school district or open-enrollment charter school to report information relating to the implementation of regulations or authorization of school guardians to the Texas School Safety Center and the local law enforcement agency, on written request of the head of the agency. The bill would also require that information on the identity of a school guardian is confidential and would not be not subject to disclosure by a school district, an open-enrollment charter school, the Texas School Safety Center, or a law enforcement agency.

Vote Recommendation Notes

While we support school guardian programs which help to ensure the safety and security of public school students and employees, SB 838 is primarily administrative in nature with no clear connection to our liberty principle. Texas Action is neutral toward SB 838.
