Bill Analysis

SB 788 would create a state-wide, Family Educational Rights and Privacy Act-compliant, data sharing model of student information to be adopted under voluntary participation between public schools, public or private institutions, state and local workforce entities and third-party entities authorized to receive this data.

Vote Recommendation Notes

The provision in SB 788 to allow certain data relating to public school children to be shared with state and local workforce institutions is concerning as it bypasses any parental consent in the process. Texas Action views this as infringing on individual liberty and therefore opposes SB 788. Any data collected and shared outside of school-related purposes should include parental consent. Texas Action recommends this bill be amended to give parents the option to opt into this data sharing.
