Relating to the removal of solar power facilities.

SB 760 would require that a solar power facility agreement between a landowner and a solar power facility operator must include a provision that the person who leases the property for the installation of a solar power facility would be responsible for removing the solar power devices from the landowner's property, clear the land of such devices and related equipment, and restore the land to its previous condition. The bill also makes provision for injunctive relief for any person harmed by a violation of this agreement.
The bill would also require that a solar power facility agreement must provide that
the grantee shall obtain and deliver to the landowner evidence of
financial assurance that conforms to certain statutory requirements.
The purpose of this bill is to bring decommissioning requirements for solar power equipment into alignment with requirements for decommissioning of other types of power generation equipment.
