Relating to creating the criminal offense of operating a boarding home facility without a permit in certain counties and municipalities.

Bill Analysis

SB 500 would create a new criminal offense for a person who operates a boarding home facility without a permit in a county that requires county permits. The offense would be a Class B misdemeanor.

Boarding home facilities furnish lodging to three or more persons with disabilities or elderly persons who are unrelated to the owner by blood or marriage; and provides community meals, light housework, meal preparation, transportation, grocery shopping, money management, laundry services, or assistance with self-administration of medication but does not provide personal care services. 

Vote Recommendation Notes

SB 500 represents government overreach by criminalizing an activity which at most should be subject to a civil penalty. SB 500 violates the free market, limited government, private property rights, and individual liberty principles. Texas Action opposes SB 500.
