Bill Analysis

SB 402 would permit all cities (rather than just those currently bracketed) that utilize a sales and use tax for the maintenance of streets, to renew the tax for either 8 or 10 years instead of 4 years at the approval of the voters, provided the voters have previously authorized the tax twice before. The bill would allow for the tax to be used for maintenance and repair of streets, sidewalks, and water infrastructure located directly beneath the roadway.

Vote Recommendation Notes

Texas Action is neutral on SB 402. On the one hand it allows for the length of a tax to be significantly extended before it is once again subject to voter approval but on the other hand this would only be so if it has already been approved by voters in the two previous consecutive elections.
