Bill Analysis

SB 36 would make small changes to the offense of hazing. It would remove the requirement that a person who has firsthand knowledge of a hazing incident reports it in writing, requiring them instead to simply report it. Such a person would be permitted to report their knowledge to a peace officer or law enforcement agency instead of their educational institution. Individuals would also be immune from prosecution if they report a hazing incident to a peace officer or law enforcement agency on their own accord. SB 36 would also specify that an entity organized to support a student group is entitled to immunity from prosecution if they report a hazing incident on their own accord.

Vote Recommendation Notes

Texas Action is neutral on SB 36 as it does not significantly affect any of our Liberty Principles. That said, most of the provisions of this bill appear to be improvements on existing law.
