Relating to the governance of the Public Utility Commission of Texas, the Office of Public Utility Counsel, and an independent organization certified to manage a power region.

No significant fiscal implication to the State is anticipated.

Bill Analysis

SB 2 would require that board members of the organization charged with managing Texas' power grid be residents of the state of Texas. Five members unaffiliated with any market segment would be approved by the other members and the governor, lieutenant governor, and speaker of the house. The bill would make changes to the makeup of the board by increasing representation from multiple markets and would make changes to term lengths. Members would be required to serve staggered terms. Registered lobbyists and legislators could not be members of this board. Other rules and procedures for the selection and qualification of members are prescribed in the bill. 

Vote Recommendation Notes

Texas Action does not make any recommendation on SB 2 as it does not impact our liberty principles. The provision requiring members of the ERCOT governing board be residents of Texas is certainly very sensible, even if not necessarily connected to a liberty principle.
