Bill Analysis

SB 237 would permit an arresting peace officer to issue a citation to appear to a person who committed a Class B misdemeanor criminal trespass offense rather than taking them before a magistrate if that person resides in the county where the offense took place.

Vote Recommendation Notes

Texas Action supports SB 237 which benefits limited government and individual liberty by giving officers appropriate discretion with respect to criminal trespass offenses and reduces unnecessary arrests for a relatively minor offense.
