Relating to the authority of a health benefit plan sponsor to consent to electronic delivery of certain communications on behalf of a party enrolled in the plan.

SB 2124 would allow a health benefit plan sponsor (usually an employer) to, on behalf of employees enrolled in the plan, give the consent required for electronic notices or communications. The plan sponsor would only be allowed to do this if before giving consent on behalf of a party, the sponsor confirms that the party routinely uses electronic communications during the normal course of employment and gives the party the opportunity to opt-out of delivery by electronic means.
