Relating to the procedure for certain complaints against health care practitioners.

SB 2115 addresses situations in which a licensing board of a healthcare profession receives a complaint about a professional who is licensed by a different board. In that situation the board that receives the complaint would be required to forward the complaint on to the appropriate licensing board and would not be allowed to take disciplinary action unless the licensing entity that issued the license refers the complaint back to the entity that received the complaint or disciplinary action is taken for practicing medicine without a license.
While we do not support most occupational licensure and encourage the legislature to reduce licensure at every possible opportunity, we do recognize that so long as there are licensed occupations each licensed occupation should only be subject to the jurisdiction of its own licensing board rather than any board that happens to field a complaint. This bill would moderately support individual liberty for licensed healthcare professionals by limiting the circumstances under which they would be subject to the jurisdiction of a licensing entity different from the one they are licensed under. For this reason we support SB 2115.
