Bill Analysis

SB 1947 would require a municipality to submit a written notice to an applicant for a building permit explaining why the municipality was unable to grant or deny the permit if the municipality does not take either action in 45 days. If the municipality fails to comply with this requirement then the municipality would be prohibited from collecting any related permit fees and would have to refund any such fees that had been collected. The municipality would be prohibited from denying an application for a building permit solely because the municipality is unable to comply with certain applicable laws or from requiring an applicant to waive certain requirements.

Vote Recommendation Notes

Texas Action supports SB 1947 as this bill would increase government efficiency and responsiveness which supports the limited-government principle.
