SB 1901 would expand existing law allowing the secretary of state to order an official administering the state’s electoral processes to correct offending conduct if the secretary of state determines that the action of the election official causes a delay or cancels an election which they do not have the authority to delay or cancel, unless they are acting under an order of a court.
Texas Action supports SB 1901 because it helps the government fulfill it's lawful duties without infringing on the rights of Texans. This bill would enact additional security to Texas elections by preventing election officials for delaying or canceling elections without approval from the secretary of state or a court of competent jurisdiction. This would address situations in which local elected officials extend their own tenure in office by simply refusing to hold a scheduled election.
