Bill Analysis

SB 1585 would require, in the case of there being more than one, that a municipality designate one zoning, planning, or historical commission as the final authority over establishment of historical landmarks. Additionally, the bill would prohibit a municipality from designating a property as a local historic landmark or including a property within the boundaries of a local historic district unless the landowner consents or there is three-fourths voter approval.

Vote Recommendation Notes

SB 1585 would enhance property rights and limited government by raising the threshold necessary to designate a property as a historical landmark over the wishes of the property owner.
