Relating to remedial plans issued by the State Board of Dental examiners to address complaints against dentists and dental hygienists.
No fiscal implication to the State is anticipated.
SB 1534 would allow the State Board of Dental Examiners to remove from their public website any information regarding a remedial plan for a dentist or dental hygienist on or after the fifth anniversary of the date the remedial plan was issued unless the complaint was related to the delivery of health care or more than one remedial plan had been issued to resolve the same complaint and was not related to the delivery of health care. This is to address remedial plans for minor administrative issues which have been corrected over time. The same opportunity is afforded to other healthcare professionals for the same purpose.
SB 1534 would allow the State Board of Dental Examiners to remove information regarding a remedial plan related to minor administrative noncompliance or errors from a dentist's or dental hygienist's record that is posted on the TSDBE website after five years unless the remedial plan involved a violation in the provision of healthcare.
This bill would aid the individual liberty of those in the dental profession from having to have a non-healthcare related remedial plan permanently on their record. Texas Action supports SB 1534.
