Relating to the prosecution of the offense of operation of an unmanned aircraft over certain facilities.

No significant fiscal implication to the State is anticipated.

Bill Analysis

SB 149 would expand the current law regarding the operation of an unmanned aircraft over a correctional facility, detention facility, or critical infrastructure facility to now include a public or private airport depicted in any current aeronautical chart published by the Federal Aviation Administration and a military installation owned or operated by or for the federal government, the state, or another governmental entity. The bill makes no changes to the level of offense of such an action. 

Vote Recommendation Notes

The statute to which this bill applies includes sufficient mens rea protection to prevent overcriminalization, therefore expanding the prohibition on flying unmanned aircraft over these facilities does not infringe on our liberty principles and we remain neutral on SB 149.
