Bill Analysis

SB 1313 would enumerate an individual's right to choose and make decisions regarding the medical treatment provided to them or their child and the right to refuse a control measure. Control measures are implemented by a state or local health authority to control the spread of disease in the exercise of its power to protect public health. In order to issue such a control measure, the State Department of health or a local health authority would have to provide notice of the control measures and give individuals an opportunity to demonstrate that these measures would be unnecessary. SB 1313 would require these measures to be issued by the least restrictive means available, and allow an individual to isolate or quarantine in an individual's home or with a family member or friend. 

Vote Recommendation Notes

SB 1313 would restrict government and enhance individual liberty with respect to control measures intended to prevent the spread of disease. Free citizens are capable of making their own quarantine plans and decisions without having "control measures" imposed by bureaucrats. SB 1313 benefits the principles of individual liberty, personal responsibility, and limited government. Texas Action supports SB 1313.
