Bill Analysis

SB 1181 would update the remedies available to the owner of a self-storage facility who places a lien for nonpayment on a vehicle, boat, trailer, or boat motor stored at the facility.

SB 1181 would allow a self-storage lessor who takes possession of a tenant's motor vehicle, boat, trailer, or boat motor to enforce a lien to tow the property to a vehicle storage facility. A vehicle storage facility that accepts possession of such property would be able dispose of the motor vehicle in accordance with existing law after sending required notices to the property owner. The bill specifies that a lessor who takes advantage of this alternative is not liable for damage caused to property that is towed under the provisions of this bill.

Vote Recommendation Notes

As SB 1181 does not weigh on our liberty principles, Texas Action is neutral on this bill. In this situation both the lessor and tenant have property rights at stake. This bill does not appear to upset the balance of those rights in a way that infringes on either party.
