Bill Analysis

SB 111 would require law enforcement agencies to submit a written statement when filing a criminal case with a state attorney acknowledging that they have transmitted all items to the state attorney that are required by law to be disclosed to the defendant. If any such item is discovered after the case has been filed, the agency would be required to promptly transmit it to the state attorney.

Vote Recommendation Notes

Texas Action supports SB 111 because it would promote individual liberty and limited government. SB 111 would ensure that disclosure requirements apply to law enforcement agencies completing criminal investigations. This would help ensure that prosecutors timely receive all exculpatory evidence and are in turn able to disclose that evidence to a defendant. It would also reduce the chances of a law enforcement agency withholding exculpatory evidence from a prosecutor in order to prevent the prosecutor from sharing it with a defendant.
