Bill Analysis

SB 1055 would make it a Class A misdemeanor criminal offense to, with criminal negligence, operate a motor vehicle in the area of a crosswalk and cause bodily injury to a pedestrian or person operating a bicycle or other type of vehicle. The offense would be a state jail felony if the victim suffers serious bodily injury. It would be an affirmative defense to prosecution if the victim was violating a law relating to movement on a crosswalk.

Vote Recommendation Notes

Texas Action supports SB 1055 because it would advance personal responsibility. No specific criminal offense in current law applies to a driver who negligently injures a pedestrian moving across a crosswalk. SB 1055 would provide criminal penalties for such an act, ensuring that offenders are held responsible in criminal courts in addition to civil courts.
