Relating to the execution of a search warrant for taking a blood specimen from certain persons in certain intoxication offenses.

Bill Analysis

SB 1047 would permit a search warrant issued to collect a blood specimen from a person suspected of committing certain intoxication-related offenses to be executed in a county adjacent to the county in which the offense took place and warrant was issued, and by any law enforcement officer with arresting authority in the county of execution.

The purpose of this bill is to allow the blood sample to be drawn in a hospital that serves the county in which the arrest took place and warrant was issued but is located in an adjacent county. 

Vote Recommendation Notes

Texas Action is neutral on SB 1047. We originally opposed the bill when it was under consideration by the Senate, however our concerns have been alleviated upon further review and after discussing with the House sponsor's office. This bill addresses a practical issue without infringing on the rights of defendants.
