SB 1025 would clarify that the power to suspend criminal, election, or penal codes or restrict occupancy limits of businesses or places of worship during a state of emergency is reserved to the legislature of Texas. SB 1025 would not prevent the governor from issuing directives following a state of emergency. This bill would restrict the governor's ability to suspend or limit the sale, use, and transportation of alcoholic beverages, firearms, explosives, and combustibles during times of disaster unless there is unrest, riot, or an open revolt.
This bill would also require the governor to convene the legislature in a special session to renew a state of disaster proclamation.
SB 1025 is the enabling legislation for SJR 45.
