Bill Caption

Relating to conditions of community supervision prohibiting contact with certain persons.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

HB 787 would bar a judge from prohibiting a defendant from communicating, as a condition of their community supervision, with a person who belongs to an organization that includes people with criminal histories that advocate for criminal justice reform or offer programs to formerly incarcerated individuals.

Vote Recommendation Notes

Texas Action supports HB 787 because it would protect the constitutional rights of those under community supervision. Judges should not be able to restrict a defendant’s contact with an organization that provides services to convicted persons or advocates for criminal justice reform. Contact restrictions placed on offenders ought to be limited to persons that encourage the offender towards criminal activity.
