Relating to restrictive covenants related to swimming pool enclosures.

Fiscal Notes

No fiscal implication to the State is anticipated.

Bill Analysis

HB 67 would prohibit HOAs from imposing or enforcing a mandate that prevents property owners from installing swimming pool enclosures on their own property. The bill would however allow an HOA to prohibit a pool enclosure from being any color other than black.

Vote Recommendation Notes

Texas Action is neutral on HB 67 which infringes on limited government by dictating terms of HOA agreements but on the other hand supports property rights by allowing property owners to place an enclosure around their swimming pool for safety purposes.
