Bill Analysis

HB 631 restricts the power of local governments to interfere with the granting of permits or the regulation of municipal solid waste facilities. This bill makes it so applicants for a permit for siting, construction, or operation of a municipal solid waste facility don't need to seek permits from local governments and local governments can't make a rule or ordinance that conflicts with or is inconsistent with some state polices regarding such facilities.

HB 631 may not be construed to deny a county or municipality the ability to exercise powers granted under the comprehensive municipal solid waste management resource recovery and conservation act, county solid waste control act, and the national flood insurance program.

Texas Action supports HB 631. The bill limits local governments' ability to impose overbearing or arbitrary regulations on municipal solid waste facilities which supports our limited government principle.
