Relating to the creation of a specialty treatment court for certain individuals residing with a child who is the subject of a juvenile court case.
No significant fiscal implication to the State is anticipated.
HB 454 would permit counties to create juvenile family drug
court programs to handle cases of adult offenders with substance abuse problems
that reside in the home of a child with a pending juvenile criminal case. An
individual handled through such a program could be required to pay for all of
their treatment within the program based on their ability to pay. HB 454 would
encourage counties establishing such a program to use court improvement project
money or matching money from the federal or state government to fund it.
Texas Action is neutral on HB 454 as it does not touch directly on any of our Liberty Principles. While it would allow counties to create a new type of specialty court, such a court would only redirect existing cases. It also would not require such courts to be created or provide specific funding for them.
