Relating to the provision of certain eminent domain information to property owners through a landowner's bill of rights.

Bill Analysis

HB 448 would allow property owners additional rights and protections from eminent domain such as the ability to file a complaint with the ombudsman office, to be established by the Texas Real Estate Commission, regarding alleged misconduct by a representative of the entity while exercising the entity’s eminent domain authority. Misconduct means criminal trespassing or an intentional action that misrepresents to the landowner the landowner's rights, the entity’s power to condemn, the intended use of the property or the condemnation process.
