Bill Analysis

HB 4447 would prohibit a municipal planning commission or the governing body of the municipality from requiring a person to submit or obtain approval of a required planning document or fulfill any other prerequisites or conditions before the person files a copy of the land development application unless the requirement is adopted by ordinance and the municipality made required documents publicly available. An individual may submit required documents with their application or after submitting their application. The municipal body may not deny the application based on failure to submit documents if the municipal body did not adopt the requirement by ordinance and make them publicly available.

This bill would also allow applicants to remedy a required document that was disapproved by a municipal body by submitting a written response to the relevant governing body that resolves the reasons for disapproval.

Under this bill, a municipality would be required to establish a bifurcated approval procedure preliminary plan or plat and a final plan or plat if such proceedings are requested from at least five applicants.
