Bill Analysis

HB 4012 would require a HMO or insurer that preauthorizes an enrollee’s health care service to provide a disclosure to the enrollee if the service is elective, will be provided at a licensed medical facility and requires preauthorization. The disclosure notice would also have to include estimated costs and several warning statements.

Vote Recommendation Notes

Texas Action opposes HB 4012 because it violates the limited government and free market principles. The state should not be in the business of managing the practices of HMOs or insurers by adding new mandates.
