Bill Analysis

HB 3920 would allow a person to vote absentee if the voter has a disability or is expected to give birth to a child within three weeks of election day. 

HB 3920 would prohibit a person from voting absentee on the grounds of lack of transportation, sickness that does not prevent the voter from appearing at the polling place on election day without a likelihood of needing personal assistance or of injuring the voter’s health, or being required to work on election day. 

The bill would require an application for a mail-in ballot requested due to sickness or physical condition to include an affirmative statement indicating that fact. The bill prescribes the language to be used for this purpose.

Vote Recommendation Notes

Texas Action supports HB 3920 because it espouses the limited government and individual liberty principles by helping to make Texas elections more secure. This bill would limit the use of absentee votes which are less secure than in-person voting.
