Bill Analysis

HB 3713 only applies to a district that controls a ship channel or waterway that is the subject of a project that has been authorized or modified by the U.S. Congress in the Water Resources Development Act of 2016 or 2020 and entered into a lease before the effective date of this Act.

HB 3713 would allow a district which has entered into a surface lease of at least 20 years to sell the land, improvements, easements, and any other interest in the property or any part of the property to the surface lease counterparty. The sale must be approved by the port commission, executed by the chair of the port of commission, attested by the executive director of the district, and made in the amount that is not less than the market value of the land or improvements.

HB 3713 allows private entities to purchase such land listed.

Money received from the sale of the real property will be only used for the purpose of a project that has been authorized or modified by the U.S. Congress in the Water Resource Development Act of 2016 and 2020. 

Vote Recommendation Notes

HB 3713 would allow qualified ports to sell property to a long term lessee in order to raise funds for port dredging projects which have been approved but not funded by Congress. This would transfer more property ownership into private hands and generate revenue for needed port dredging. We support HB 3713.
