Bill Analysis

HB 3571 would prohibit a property owner's association from adopting or enforcing a restrictive covenant that prevents a property owner from building or installing security measures, including but not limited to a security camera, motion detector, or perimeter fence.

The bill specifies that while a property owner's association cannot prevent a property owner from installing a fence, it can regulate what kind of fences are allowed.

Vote Recommendation Notes

We oppose government interference in private contracts, including the willing agreement made among property owners who are members of a property owners' association. On the other hand we support the right of private property owners to use their own property as they see fit so long as they are not infringing on the rights of others. Texas Action remains neutral on HB 3571.
