Bill Analysis

HB 3433 would prohibit certain types of insurers from discriminating on the basis of political affiliation or expression. Specifically, the bill states that a person "may not refuse to insure or provide coverage to an individual, refuse to continue to insure or provide coverage to an individual, limit the amount, extent, or kind of coverage available for an individual, or charge an individual a rate that is different from the rate charged to other individuals for the same coverage because of the individual’s political affiliation or expression."

Vote Recommendation Notes

Texas Action opposes HB 3433 which is inconsistent with free markets and limited government. While it would certainly be bad behavior for an insurance company to discriminate based on political affiliation or expression, it is not the state's proper role to mandate good behavior by private businesses. If an insurance company chooses not to do business with a person due to the person's political views or expression, the person may take their business elsewhere.
