Relating to standing for receipt of exemplary damages based on a compensable death under the Texas Workers' Compensation Act.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

HB 3158 would expand current law regarding compensable deaths to allow the parents, including adoptive or step-parents, of a deceased worker to sue the worker's employer for a compensable death under certain circumstances.  The bill specifies that this privilege would not be extended to parents whose parental rights have been revoked.

Vote Recommendation Notes

Texas Action supports HB 3158 because it espouses the individual liberty principle by providing a method of civil recourse for the parents of a deceased worker to sue their child's employer for a compensable death.
