Relating to the eligibility of an injured employee for lifetime income benefits under the workers' compensation system.
No significant fiscal implication to the State is anticipated.
HB 3120 would expand the criteria for an employee to qualify for lifetime income benefits under the workers’ compensation system. New criteria includes a permanent major neurocognitive disorder or a psychotic disorders, seriously body injury that permanently prevents the employee from performing any gainful work and the placement of third degree burns.
The bill would also add to the criteria, permanent and total disability as determined by the Bureau of Justice Assistance of the United States Department of Justice under the Public Safety Officers’ Benefits Act of 1976, specifically for first responders employed by a political subdivision that self-insures, either individually or collectively.
