HB 3110 would rename the criminal offenses of possession or promotion of child pornography to possession or promotion of child sexual abuse material. It would increase the penalties for the possession of child pornography from a third-degree felony to second-degree felony. It would create a minimum term of imprisonment of five years for the intentional promotion of child pornography, currently a second-degree felony. If enacted, a person convicted of possession or promotion of child sexual abuse material would become ineligible for community supervision.
Texas Action is neutral on HB 3110 because it does not significantly affect our Liberty Principles. As long as the penalties for certain conduct remain proportional to the crime, increasing them does not hinder individual freedom.
