Bill Analysis

HB 3042 would allow the Commissioner of Worker's Compensation to at any time amend or replace the treatment guidelines, return-to-work guidelines, individual treatment protocols or formulary adopted under current law to ensure the guidelines, protocols, and formulary are current and comply with changing requirements.

Vote Recommendation Notes

Texas Action is opposed to HB 3042. Allowing the commissioner, free from accountability and oversight, to change rules at will is inconsistent with limited government. If the relevant guidelines need to be revised, this should be done by the legislature.
