Bill Analysis

HB 2856 would prevent a provider who participates in Medicaid or the child health plan program, from refusing to provide healthcare services to a Medicaid recipient or child health plan program enrollee based on the recipient's or enrollee's refusal or failure to obtain or vaccine or immunization for a particular infectious or communicable disease. 

HB 2856 would prevent the Health and Human Services Commission from providing reimbursement and would be required to disenroll such a provider who violates this section. 

Vote Recommendation Notes

Texas Action supports HB 2856 which prevents providers who participate in a government run subsidy program from discriminating against program enrollees based on their vaccination status. The government would be correct to not actively participate in this type of discrimination.
