HB 2716 would require the Texas Commission on Environmental Quality (TCEQ) to furnish to the Texas Department of Parks and Wildlife (TPWD) a copy of all permit applications to store, take, or divert water. The bill would allow TPWD to make recommendations to TCEQ to protect fish and wildlife resources, except in certain proceedings for an individual water right governed by environmental flow standards.
TPWD be allowed to request a hearing and full party status on a permit or authorization under review by TCEQ that is subject to notice and opportunity for hearing and may adversely affect property or fish and wildlife resources managed by the department.
Texas Action opposes HB 2716 which would grow government and impair property rights by adding another agency to the review process for certain permits. This would most likely increase costs for applicants by dragging the process out longer. TCEQ is an agency capable of taking all environmental concerns into account in the permitting process, including concerns held by TPWD.
