Relating to the protective order registry maintained by the Office of Court Administration of the Texas Judicial System and the removal of certain vacated protective orders from the registry.
No significant fiscal implication to the State is anticipated.
HB 2702 would add protective orders issued to prevent sexual assault, stalking, or trafficking to the protective order registry maintained by the Office of Court Administration. The date a protective order was vacated would no longer be publicly accessible information; instead, the relevant court clerk would be required to remove any record of an order from the registry if it is vacated. Court clerks would be required to inform the Office of any protective order that is vacated as the result of an appeal or bill of review so that the Office can remove it from the registry.
Texas Action is neutral on HB 2702 as, on balance, it does not significantly affect any of our Liberty Principles. While the bill would remove vacated protective orders from the registry, protecting the due process rights of the subjects of such orders, it would also expand the list of orders included in the registry.
