Relating to procedures in certain suits affecting the parent-child relationship filed by the Department of Family and Protective Services.
No significant fiscal implication to the State is anticipated.
HB 2308 would make changes to the required affidavit for a suit
filed by a governmental entity that requests permission to take possession of a
child without prior notice and a hearing, and require that certain findings be
made by a court. The bill would also create a process by which an alleged child
abuser could voluntarily agree to a court order to leave the home where the child
resides rather than have the child experience the trauma of removal by the state.
Agreeing to voluntary removal would not constitute an admission of guilt.
Texas Action supports HB 2308 because it would advance individual liberty and limited government in a way that would be least traumatic to children and potentially reduce the number of children who are removed from their homes by the state.
