Relating to applicability of the International Swimming Pool and
Spa Code to certain pools, spas, and other swimming areas.
No significant fiscal implication to the State is anticipated.
HB 2205 would direct the executive commissioner of the Department of Health and Human Services to by rule adopt safety standards for public pools which adhere to the International Swimming Pool and Spa Code that is not older than the version in effect on May 1, 2019. While making this requirement, the bill would also stipulate that the department is not required to take certain actions to enforce it.
The bill would also allow a municipality to adopt a more recent version of the International Swimming Pool and Spa Code than the May 2019 version.
While we do not necessarily endorse statewide implementation of any code for swimming pools and spas, we do agree that the decision regarding what code to enact if any is properly vested in the legislature rather than in the bureaucratic rulemaking process at a state agency.
