Bill Analysis

HB 2179 would revise the property code with respect to various types of trusts. The bill would make changes to the definition of a "qualifying trust" as it relates to express trusts for the purposes of certain homestead protections. The bill would also create new rules for the beneficiaries of spendthrift trusts and the appointment of an attorney to represent an interest in a trust proceeding.
