Bill Analysis

HB 1970 would require a property owners’ association board to establish an enforcement policy regarding fines that must include each category of restrictive covenants for which the association may assess a reasonable fine and a a schedule of fines for each category of violation.

HB 1970 would also require the board to file the enforcement policy with their county clerk.

Vote Recommendation Notes

Texas Action opposes HB 1970 because it violates the limited government principle.  While we sympathize with the bill's aim to protect property owners from unfair fees, property owners' association boards should not have to file a fee schedule with the government.
