HB 193 would require a juvenile court, when the minor becomes 18 years of age, to destroy the records of a person charged with prostitution and referred to a juvenile probation department if the person was trafficked for sexual purposes or forced into the prostitution. Whether or not the person’s charge has been adjudicated would not matter.
Texas Action supports HB 193 because it would advance individual liberty and limited government. Having a criminal history often leads to collateral consequences for a prior convict, including being denied from employment and housing. Those who were forced into committing prostitution as a juvenile, criminal conduct outside of their control, should not have to deal with such collateral consequences.
