Relating to the continuity of services received by individuals receiving services at state hospitals and state supported living centers, the establishment of a pilot program to provide behavioral health or psychiatric services to certain residential care facility residents, and court orders for psychoactive medication for certain patients. 

Fiscal Notes

The fiscal implications of the bill cannot be determined at this time due to the unknown structure and utilization of the Temporary Transfer Between Residential Care Facilities Pilot Program. 

Bill Analysis

HB 1824 would allow the Health and Human Services commission to establish a pilot program to provide for temporary transfers of residents from originating residential care facilities to alternate residential care facilities to provide behavioral health or psychiatric services for those residents. 

This program would have to include: one alternate residential care facility for psychiatric services; and one or two alternate residential care facilities for intensive behavioral health services. The Executive Commissioner for the Health and Human Services Commission would be required to develop rules for the type of information collected. To help in this rule adoption, HB 1824 would require a work group to be established to serve as consultants. 

Vote Recommendation Notes

The pilot program this bill would expand the scope and cost of government which is inconsistent with our limited government principle. Furthermore, we have serious reservations about sending people between various residential care facilities and to state supported living centers for psychiatric care. This may lead to the dispensation of unwanted psychiatric care and medication. Texas Action opposes HB 1824.
