Bill Analysis

HB 1793 would prohibit an insurer from entering into a verbal contract that wholly or partly releases the insurer from property damage or an injury for which an insurer may be liable under an automobile insurance policy in exchange for money or other consideration paid.

Vote Recommendation Notes

Texas Action opposes HB 1793 because it violates the limited government, free market and personal responsibility principles. The state should not be in the business of mandating terms of the insurer/insured relationship. So long as the party to an insurance claim is an adult, a party should be allowed to verbally settle with an insurer and drop their claims if they so choose.
