Bill Analysis

HB 1788 would make public and private schools immune from liability for any reasonable action taken by a security officer or an employee with written permission to carry a firearm to maintain the safety of campus. Security officers themselves would also be immune from such liability.

Vote Recommendation Notes

Texas Action supports HB 1788 because it would promote personal responsibility and prevent legal judgment against reasonable behavior. Security personnel and firearm-carrying employees should not create liability for their school in a civil action for behavior that a court deems reasonable under the circumstances. HB 1788 would prevent frivolous lawsuits against schools and officers while still providing grounds for legitimate lawsuits to go forward.
