Bill Analysis

HB 170 would add unlicensed and unpermitted places (in addition to licensed and permitted places) to the definition of a public place for the purpose of prohibiting alcoholic beverage consumption on Sundays between 1:15am and 12 noon or on any other day between 12:15am and 7am. The a violation of this prohibition is a Class C misdemeanor.

Vote Recommendation Notes

Texas Action opposes HB 170 which is inconsistent with our limited government and individual liberty principles. An unlicensed or unpermitted place should not be regulated the same way as a licenced or permitted place under the Alcoholic Beverage Code.
