Bill Analysis

HB 1394 would require a court to automatically issue an order of nondisclosure of criminal record information for a qualifying person convicted of most misdemeanors seven years after the completion of their sentence or their discharge from community supervision. The only misdemeanors excluded would be fine-only traffic offenses and certain alcohol offenses.

Vote Recommendation Notes

Texas Action supports HB 1394 because it would advance individual liberty and limited government. Having a criminal history affects a person's ability to gain employment and housing. HB 1394 would entitle those with less serious offenses on their record, and who meet qualifying criteria, to automatically gain nondisclosure orders after a period of time, thus increasing their opportunity to improve their life.
